You Cannot Be Arrested For Breach Of Contract/Refusal To Pay Debt

You Cannot Be Arrested For Breach Of Contract/Refusal To Pay Debt.

DAILY LAW TIPS by Onyekachi Umah,Esq. (Tip 205)

“You Cannot Be Arrested For Breach Of Contract/Refusal To Pay Debt.

It is not an offence to owe any person, no matter the amount owed and duration. It also not an offence to breach any agreement(contract) whether written or oral. Business gone bad is not an offence. What is morally wrong is may not be legally wrong!

Nigerian Police and other law enforcement agencies have NO business with the recovery of debt and settlement of disputes arising from contracts or any civil issue. Go to court and not to police station!

Note that, law enforcement agents and agencies may only be engaged only where there is a crime or suspicion of crime. Avoid engaging lawyers or law enforcement agents to write petition that miraculously attempt to turn civil disputes into criminal offence without ingredients of a crime.

My authority is section 8 (2) of Administration of Criminal Justice Act, 2015 and similar laws across Nigeria.
