Is it Illegal to Spray or Dance on Naira Notes (Money) in Nigeria? Daily Law Tips (Tip 254)

The Central Bank of Nigeria determines the legal tender of Nigeria. Naira and Kobo are the official currency of Nigeria. When one earns or gets Naira and Kobo the person decides how to spend his money. The spender can decide to buy properties, make gifts, keep savings and even give loans. Books, tomatoes, art works and cars, like many other properties, can be used as their owners wish. Does that apply to the Nigerian currency: Naira and Kobo? Can one lawfully spray and dance on Naira and Kobo? Is it a crime to spray and dance on Nigerian currency?

Currency is not like books, tomatoes, art works and cars that can be used as their owner pleases, so far as no law or right is breached. Books, tomatoes, art works and cars cannot truly be used as one may wish. For instance, the owner of a book cannot litter public places with his book. A car owner cannot change his car’s colour without a notice to government or use his car without a seat belt and drivers license.

It is the right a person to earn and keep money and even dance in social events. However, Nigerian currency belongs to the government of Nigeria and not its holder. And, a federal government legislation (the Central Bank of Nigeria Act) prohibits the use of Nigeria currency for some purpose.

It is illegal to spray, sprinkle, shower or throw Naira notes in any part of Nigeria. It is also illegal to dance, step or match on Naira notes in any event including social gatherings in any part of Nigeria.
They are offences punishable with not less than 6 months imprisonment and or fine of N50,000.00.
