“Who Owns Creations, Discoveries and Inventions Made By An Employee/Agent?

While at work, employees, staff, workers and even agents make registrable intellectual properties(creations, discoveries and innovations) worth billions of Naira. The ownership of such intellectual properties belongs the employers and masters of such employees, workers and agents. Such ownerships are not negotiable or changeable by any agreement because it is provided by law to always belong only to employers. It is understandable because employees use the resources of their employers in making their discoveries and creations.

My authorities are sections 2(4) and 14(4) of the Patent and Designs Act.

Your business, company, office, school, church, group and even personal “Trade Marks” are registrable, transferable,  marketable and even create exclusive use like any other property. Trademarks include distinctive and distinguishing signs, marks,  symbols or indicators in the form of words, letters, numbers, drawings, shapes, labels, colours, pictures or combination of all or some of the above elements. 
Women CAN register, own and deal on Trademarks & other IPs too!

Over time in business and life generally, individuals, partnerships, corporations, organisations and companies have developed, designed, created, coined, formed and used certain distinctive names, logos, crests, flags, badges, symbols, signs, patterns, formations, processes and drawings to differentiate themselves from others; owing and using same exclusively. In today’s world, a circled letter “Y” is owned  by Mercedes, GMC is owned by General Motors Corporation, LEX10® is owned by Lex10 Law Technologies, HP® is owned by Hewlett-Packard Company , Closeup® is owned by Unilever Nigeria Plc, MR.BIGG’S®  and GALA® is owned by UAC foods Plc and Blackberry® is owned by Research in Motion etc. All those are names, logos and products used in business by their respective owners to the exclusion of all other persons and companies in the parts of the world, where they are registered.  To retain customers and clients, create a renowned brand and fight piracy, registration of trademarks becomes very necessary.
