The Nigerian Electricity Regulatory Commission’s (NERC) ORDER ON UNAUTHORISED ACCESS, METER TAMPERING AND BY-PASS, 2017 (ORDER NO.:NERC/REG/41/2017, was made to reduce unauthorised access to electricity supply by tampering and meter bypass. It provides conditions for reconnecting a customer that was earlier disconnected for unuthorised connection to electricity. The Order has 6 paragraphs and tables of punitive charges.

The Nigerian Electricity Regulatory Commission’s (NERC) CONNECTION AND DISCONNECTION PROCEDURES FOR ELECTRICITY SERVICES, 2007, governs connection and disconnection of customers to electricity across Nigeria. It lists conditions for disconnection of an electricity customers and prohibits wrongful disconnection. The Regulation is short and precise with 14 sections. 

WHAT IS THE PERIOD WITHIN WHICH YOU MUST BE CONNECTED TO ELECTRICITY IN ANY PART OF NIGERIA. DAILY LAW TIPS (Tip 316) By Onyekachi Umah, Esq., LLM. ACIArb(UK).

It is the responsibility of electricity Distribution Companies (DisCo) to connect any person in any part of Nigeria to electricity.
Where an existing customer has paid and provided needed information for supply of electricity, the DisCo in charge of the area must supply electricity to such customer within 48 hours.

Where an already existing customers desires to be connected to electricity, such customer is expected to write an application to the DisCo in charge of his area and also forward copy of his means of identification. Such customer must also accept the terms and conditions of the DisCo as well as pay all connection charges or security deposit requested by the DisCo and approved from Nigerian Electricity Regulation Commission (NERC). Where you are not sure of charges demanded by an DisCO, please write to NERC for confirmation, it is your right.

WHAT ARE THE APPROVED METER RECONNECTION FEES & ADMINISTRATIVE FEES FOR ELECTRICITY CONSUMERS ACROSS NIGERIA.

First of all, note that the Electricity Distribution Company (DisCo) in charge of an area can disconnect a customer without any notice where such customer has an illegal network/connection or the customer’s connection is dangerous to health or integrity of the network or quality of supply to other consumers or also the meter of a customer is not accessible to be read for 3 consecutive bills.

Where for any of the above reasons a meter is disconnected, it will be reconnected after concerned customer makes satisfactory electricity supply arrangement and pays a reconnections fee or agrees to pay such to the DisCo. After payment, a customer must be reconnected with 48 hours.

The approved Reconnection Costs/Fees are;

1. Residential or Commercial Property with Single Phase meter pays N50,000.00 for first time but N75,000.00 for subsequent times.

2. Residential or Commercial Property with three Phases meter pays N100, 000.00 for first time but N150, 000.00 for subsequent times.

3. Property with Maximum Demand (MD) Meter pays 300% of the last authorised recorded monthly consumption of the customer for first time but 450% for subsequent times.

Also note that, apart from the reconnection costs/fees, such customer must pay administrative charges and also back-bills. Back-bills are to be charged at the prevailing tariff of the customer for the established period that such customer used illegal electricity. The approved administrative charges are;

1. Residential property with single phase meter pays N1,500 but Residential property with three phases meter pays N3,000.

2. Commercial Property with Single Phase meter pays N3, 000.00 but Commercial property with Three phase meter pays N6,000.

3. Residential property with Maximum Demand LV or HT meter pays N7,500.

4. Commercial property with Maximum Demand LV metern pays N7,500.00 and

5. Commercial property with Maximum Demand HT meter pays N15,000.00.

“Electricity Meter and Rights of Electricity Consumers in Nigeria”.

1. Meter Assets Provider (MAP) has a duty to repair or replace a customer’s faulty meter within 2 working days.
2. The repair or replacement of faulty meter shall be at no cost to the customer within the amortisation period, if the damage is not his fault.
3. Where MAP fails to repair or replace a meter within 2 days, the customer shall not pay metering service charge/fee for that period.
4. Where MAP is unable to provide a replacement meter, electricity bill will be calculated on average of the last 3 months bills.
5. A relocating customer within a franchise area shall apply to the Distribution Company(DISCO) for transfer of services and unspent energy credits.
6. Meter shall to be installed free of charge but customer will be charged for metering service every month via energy bills.
7. Customer can elect to pay for meter and installation in full upfront/ahead of meter installation to avoid monthly metering service charge.
8. Where a customer elects to pay for a meter, same shall be installed at his premises within 10 working days of his payment.
9. Meters and metering equipment shall be insured by MAP.
10. Within 120 days from 3rd April 2018, the Nigerian Electricity Regulatory Commission will issue an Order limiting chargeable bills of unmetered customers to avoid outrageous estimated billing systems.

“Conditions For Disconnection of Electricity Supply of a Customer by any Electricity Distribution Company in Nigeria.”

No electricity distribution company in Nigeria can disconnect your electricity supply even when you are owing unless;

1. A correct bill with a clear payment date is served on you.
2. You are given at least 10 working days to pay from the date of receipt of bill.
3. There is at least 3 months between the payment date and the date of disconnection and 
4. You have received a written warning that your electricity supply will be disconnected if payment is not made.
