Onyekachi Umah is a private Legal Practitioner with amazing experience in human right, criminal law and civil law including; pre-trial detention, human rights enforcement, intellectual property, transaction and regulation advisory, corporate, commercial, investment law and energy law as well as litigation and arbitration arising from them. He is a Legal Awareness Expert and also a Certified Arbitrator both in Nigeria and the United Kingdom. He is a member of the Chartered Institute of Arbitrators (UK) and a Certified Conflict Management Practitioner and Negotiator. He is a member of prestigious “Young ICSID” of International Centre for Settlement of Investment Disputes (ICSID), Washington DC. Among other, he has a certificate in Law of Contract from a program of Harvard University, a certificate in International Environmental Negotiation from United Nations Institute for Training and Research, Geneva and recently, a certificate in Conflict Management from United States Institute of Peace, Washington, D.C. He also holds a master of laws degree and he is a doctoral student at the faculty of law, NSUK. 

Onyekachi is the managing partner of a leading law firm; Bezaleel Chambers International. He is the founder and President of a free law awareness platform known as www.LearnNigerianLaws.com that promotes awareness and understanding of rights and laws of Nigeria (#SabiLaw) and offers free daily law tips (#DailyLawTips). Understanding the challenges of Administration of Criminal Justice in Nigeria, he dedicates his daily law tips every Mondays to promoting Criminal Justice (#CriminalJusticeMonday). Recently, he started a new series on Election Laws tagged (#SabiElectionLaws) to increase legal awareness on elections laws, policies and regulations in Nigeria. Mr. Umah has written over Four Hundred (400) free to access articles and materials on law with a desire to enlighten the public. He is also on the board of companies and non government organisations. Among others, he is serving as a member of the Advisory Committee for Law Clinics Partnership for Reforming Pre-trial Detention in Kuje Prison Project funded by the United States Department Bureau for International Narcotics and Law Enforcement. He is an executive member of the Pre-Trial Curriculum and Handbook Review Committee. For more selfless service, is a member of the Rotary Club of Abuja, Metro (RCAM), District 9125. He was featured as the Legal Personality of the Week by This Day Newspaper (a leading national newspaper) on its September 11, 2018 edition and was also featured on the NigeriaLawyer.com as the Legal Personality of the Week on November 14, 2018. Corporate Affairs Commence (CAC) is in-charge of registration of business, creation of lawful entities. CAC does not allow non registered and accredited agents to access their services and register incorporated trustees, except where such unaccredited person seeking to register an incorporated trustee is a member of the board of incorporated trustees that he/she seeks to register. There is need for accreditation number of accredited agent seeking to register an incorporated trustee, this makes it hard and often impossible for non-accredited persons and touts to commence and complete the process of registration. Most non-accredited persons end up engaging accredited agent of CAC to continue and complete the entire process. Besides, the processes, constitution and minutes needed for the exercise are often specialised and need the services of a lawyer-Notary Public to certify. The Portal of CAC requires accreditation numbers of its accredited agents. By the way, a non-lawyer and non-accredited agent will not be able to defend any resulting legal action in the process of objections to process during the 28days newspaper notice.
It is a criminal offence for a non-lawyer to prepare documents where such may be used in court.

Laws govern conducts of federal, state or local governments. So, until there is a law authorizing and empowering any government to demand for levies, fees and rates, no government can demand for such. Demanding for any tax, rates or levy without an enabling law is a criminal offence.

The Constitution of Nigeria recognizes Local Governments and went on to list the functions of local governments, which includes; collection of rates, fees, levies and charges. However, the constitution specifically stated that functions of local government can only be exercised by the local government after its State House of Assembly makes a law conferring such functions on the local government. Hence, local governments cannot exercise their functions until there is an enabling state law on such specific function. Also, local governments cannot make a bye-law on any issue/function until the state assembly makes an enabling law for such.

In Edo State, the state assembly made a law enabling local governments to demand and collect specific harmonised and uniform levies, rates and fees since 28 February 2017. The law further specified amounts to be paid for each levy/fee to avoid outrageous demands and assessment. Most people are not aware of the specified amounts and as such they are been defrauded.

Below are some of the levies, fees, rates and their prices approved by Edo State Government for all the local governments in Edo state. The amounts cannot be changed or reviewed by any local government rather it is only the Edo State House of Assembly that can review, change or increase any of the amounts. The levies and fees, showing the minimum and maximum of each category, are;

1. Shops, Kiosks, Containers or Workshops for Artisans pays yearly levy of #5,000.00 to #300,000.00
2. On and Off Liquor Fees is yearly levy of #3,000.00 to #150,000.00
3. Abattoir and Slaughter Houses is yearly fee of #10,000.00 to #150,000.00
4. Merriment and Entertainment Fee for per event is #5,000.00 to #100,000.00
5. Restaurant, Bakeries and Other Places Where Food Is Sold is registration fee of #15,000.00 to #100,000.00. There is no yearly fee
6. Radio and Television License Fee is yearly fee of #5,000.00 to #1,000.00
7. Marriage, Birth and Death Registration Fee is #1,000.00 to #50,000.00
8. Naming of Street Registration Fee is free to #50,000.00
9. Markets Built by Council is yearly fee of #200.00 to #100,000.00
10. Motor Parks fee yearly is #10,000 to #500,000.00
11. Domestic Animal License Fee yearly is #500.00 to #5,000.00
12. Bicycle, Canoe, Wheel Barrow and Carts Fee, yearly is #500.00 to #1,000.00
13. Sign Board(Signage) and Advert Permit Levy, yearly is #20,000.00 to #150,000.00
14. Commercial Mobile Adverts Operating Within The Local Government Area Per Van, yearly is #5,000.00 to #20,000.00
15. Charges in Health Centers per visit is #500.00 to #50,000.00

In Edo State, the State House Assembly made a law enabling local governments to demand and collect specific harmonised and uniform levies, rates and fees since 28 February 2017. The law further specified amounts to be paid for each levy/fee to avoid outrageous demands and assessment. Most people are not aware of the specified amounts and as such they are been defrauded.

For reasons unknown to us, this law that was made since 2017 is not common and worse still not available on any online platform/website. Hence, the need to make it available here for free! Until laws are easily accessible compliance and abuse will be inevitable.
